C&P. Peeradon also has experience in projects. Recent Experience Representation of Thai AirAsia X, the low fare long haul carrier, through its successful rehabilitation
process. In August 2023, the Central Bankruptcy Court issued an order for approval of the USD 1.7
billion (approximately THB 62 billion) business rehabilitation plan to revamp the company’s
administration process and restructure its debts, delivering greater efficiencies and a solid
platform for future growth. Representation of Pace Development Public Company Limited, and its affiliates in Thailand, as well as
Siam Commercial Bank Public Company Limited, in relation to the rehabilitation of Pace Development
in Thailand and reorganization of its assets and businesses, namely, Dean & DeLuca Group, in the
United States under Chapter 11 of the US Bankruptcy Code, with a total amount of claims involved in
the rehabilitation exceeding THB 30 billion. Representation of Bangkok Airways Public Company Limited, a highly successful
airline company listed on the Stock Exchange of Thailand, in a labour dispute against one of its
former top management in the Central Labour Court of Thailand, with an approximate claim of THB
52million. (2019-2020) Representation of ECC
Chiangmai Project 1 Co., Ltd. (“ECC”), the owner and operator of a community mall in
Chiangmai, in bankruptcy and insolvency cases filed simultaneously, resulting in ECC being forced to
suspend its operations. Weerawong C&P enabled the company to operate during the receivership and
negotiated with creditors to receive a debt reconciliation over THB 3,000 million. Moreover, the
team brought famous-franchises such as KFC, Starbucks and one of the biggest construction materials
store of Thailand to sign an agreement with the Client, adding value to ECC operations. This is the
first case in Thailand where the business remained in operation despite obtaining an absolute
receivership order from the Central Bankruptcy Court. (2019-2020) Representation of a carbon black company in
filing an appeal before the Supreme Court in relation to a lawsuit filed by individuals claiming
damages for the environmental impact of carbon manufacturing operations. Weerawong C&P also
advised a rayon company, the leading manufacturer of viscose staple fiber in Thailand, on a related
environmental law claim in relation to a class action filed by residents. 2019 Representation of an Indonesian entrepreneur
in several civil and criminal disputes with the co-owner of a technology and cloud computing
business in Thailand. The case involved control of the company, as well as cross-border embezzlement
of funds and misappropriation of investments procured through many successive years of fraud. The
amount in dispute was USD 25 million. (2019) Representation of Nalco Industrial Services Thailand Co., Ltd., a Thai subsidiary of
Ecolab Inc., one of the world's leading manufacturers of chemical products and providers of
technical services, in a dispute against General Motors (Thailand) Co., Ltd., the manufacturer of
Chevrolet automobiles in Thailand, concerning a breach of contract and the unilateral early
termination of the contract. |
