Raweepun Pitakchatiwong, Ph.D. is a partner of the litigation and arbitration
practice group. He has almost 20 years of professional legal experience. Raweepun is specialized in
public law, administrative law, administrative litigation, corporate law, competition/antitrust,
public sector and industrial regulations, such as telecommunications. He has vast experience both as
in-house and ex-house counsel in commercial and complex business transactions, capital markets,
consumer protection, personal data protection (PDPA), cybersecurity and dispute resolution. His
ability in handling high-profile administrative court cases (several billion USD worth) is
outstanding. He is member of the Sub-Committee of The House of Senate for Information and

Experience Representation of the Bangkok Mass Transit System
Public Company Limited (BTSC) in two cases in
connection with agreements with the Krungthep Thanakom Company regarding the operation and
maintenance of the Green Line skytrain extensions, which is a project owned by the Bangkok
Metropolitan Administration (BMA). BTSC filed two cases in 2021 and 2022 consecutively before the
Thai Administrative Court. Both cases concerned the repeated failures of the BMA and Krungthep
Thanakom to pay the debt owed to BTSC for its operation and maintenance services for the Green Line
skytrain extensions, with claims of almost THB 20 billion owed to BTSC. The key issues involved
proving to the Administrative Court that it had jurisdiction over the cases as the operation and
maintenance service contracts for the Green Line extensions are between BTSC and Krungthep Thanakom
company (two private companies) and extending the legal liabilities under the disputes to the BMA,
including allowing BTSC to sue BMA. In 2022, the Central Administrative Court rendered its judgment
on the first case ordering both Krungthep Thanakom and the BMA to pay to BTSC THB 12 billion. The
second case is under the consideration of the Central Administrative Court.
Representation of Asset World Corporation and
The Hotel Sukhumvit 50 Company Limited, a company in the AWC
group (collectively referred to as “AWC”), in several disputes at the Central Administrative Court,
the Civil Court of Southern Bangkok and criminal proceedings relating to a hotel project. AWC
launched an upscale luxury hotel in the central Sukhumvit area in compliance with all relevant laws
and regulations. However, during the construction period, a condominium located next to the hotel
project and its 500 unit holders claimed that the environmental impact assessment report and
construction licenses granted were not in compliance with the law. Weerawong C&P represented AWC
in the disputes. The overall value of these disputes was approximately THB 2.4 billion in
2022.
Representation of Syn Mun Kong
Insurance Plc (SMK), a leading non-life insurance
company in Thailand, in an administrative law dispute involving SMK’s attempt to terminate its
Covid-19 insurance policies in July 2021. The Office of Insurance Commission (OIC) issued an
administrative order prohibiting SMK and all other insurance companies from exercising their rights
to terminate their Covid-19 insurance policies as per their respective termination clauses, which
had been approved by the OIC prior to the sale of such Covid-19 insurance policies. As a result, SMK
filed an administrative court claim against the OIC and the Secretary-General of the OIC, claiming
damages incurred in the amount of approximately THB 43,587 million(USD 1,330 million) as the OIC
only has the authority to issue this order if fair compensation is given to offset the losses
incurred thereunder.
Representation of Southeast Asia Insurance Plc. and Thai Insurance Plc. (the “Companies”), well-known non-life insurance companies in
Thailand, in an administrative law dispute involving a registrar order of the Office of Insurance
Commission. The registrar order prohibited the Companies from exercising their rights to terminate
their Covid-19 insurance policies as per the termination clauses contained in their insurance
policies, without compensation, causing THB 9,576 million damage to the Companies. Weerawong C&P
represented the Companies at the Central Administrative Court in 2022.
Representation of the Cha-Am Phumiphat group, a
leading land developer and owner of land in Phetchaburi Province, in an Administrative Court case
involving a large plot of land next to the beach of the Gulf of Thailand. The Plaintiff also filed
an Administrative Court claim against several state officials (i.e., the Director of the Department
of Lands, many officials of the Department of Lands, and other related government officials)
requesting the court to revoke several land title deeds of the client valued at over THB 100 million
(USD 3 million) in 2022. In civil law proceedings, the court and all state authorities involved
found that the land title deeds were legally issued and the land thereunder does not infringe on any
public access to the sea.
Representation of Ananda Development Public Co. Ltd and its subsidiary (“Ananda”),
leaders in real estate development in Thailand, in a precedent-setting Administrative Court case in
2022. The plaintiffs led by the president of the Stop Global Warming Association submitted a lawsuit
against five state officials and agencies on claims regarding (i) the permissions for the
construction of a luxury condominium, namely “Ashton Asoke”, and (ii) the lawful authority of the
Mass Rapid Transit Authority of Thailand (MRTA) to grant Ananda the permission to use expropriated
land as passage to access public roads. The consequences of this case would impact significantly on
the real estate sector in Thailand, since there are many condominium projects using expropriated
land as passage to access public roads, along with public access to the underground train
system.
